Fly tipper in Grendon fined thousands in successful prosecution by North Warwickshire Borough Council

In a case at Coventry Magistrates' Court, a man from Tamworth has been ordered to pay thousands in fines for fly tipping in Grendon.

Mr Luke Westwood from Tamworth pleaded guilty at Coventry Magistrates' Court of fly tipping offences under s33 Environmental Protection Act 1990 ordered to pay fines and costs totalling £2,583,50 on 15th January 2020.

Mr Westwood attended Court and pleaded guilty to depositing two van loads of waste onto the garden of a residential council owned property at Little Brum, Grendon in North Warwickshire on 29 March 2019.

A member of the public observed two men open the van and put the contents including a mattress, a sofa with the seat cushions, fences, wooden panels and plastics into the garden by putting it over the fence and by entering the garden via a side gate. She recorded the incidents and reported them to the Council's Environmental Health Team who carried out the investigation.

The court concluded that it was a deliberate act and therefore fell within Band C fine of the Sentencing Guidelines. The court imposed the following sentence:

Fine - £ 120.00

Legal Costs - £ 250.00

Investigation & partial clear up charges - £2,183.50

Victim Surcharge - £34.00

Total - £2,583.50

"This case outcome will hopefully come as a stark warning to those who are considering fly-tipping and also highlight that the council investigates all reports, in this case the evidence supplied by the member of the public was extremely helpful to the investigation."
